Terms of Service

Welcome to AIR.POG ("AIR.POG", "we", "us"). By accessing or using airpog.com, our mobile/PWA app, or any related service (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

AIR.POG is a location-based discovery platform that shows nearby businesses, live deals, and user-posted "POGs" (events, sales, and listings). Core consumer use is free. Businesses may claim a listing and optionally purchase paid features (e.g., AIR.POG Pro, featured deals, POG Ads).

You are responsible for activity under your account and for keeping your credentials secure. You must provide accurate information and may not impersonate any person or business, or claim a business you are not authorized to represent.

The AIR.POG brand and ecosystem — including without limitation the names and marks AIR.POG, POGZ R US, AIR.POG NET, MR. POG / THE POGFATHER, THE POGZ FACTORY, POG BUCKS, the GOLDEN AIR.POG TICKET, the GEM VAULT, POG FEST, and the "Just POG it." tagline — together with all logos, branding, design, look-and-feel, user interface, source code, and features, are the exclusive property of AIR.POG and are protected by copyright, trademark, trade dress, and other laws.

The "AIR.POG" / "POGZ" digital collectible characters and their entire catalog (names, designs, artwork, rarities, themed series such as the GEM VAULT and RAD POGZ, and the global mint-serial system) are original works curated, named, art-directed, and arranged by AIR.POG under substantial human creative control, and are owned exclusively by AIR.POG.

Collectibles, POG BUCKS, mint serials, tickets, and similar in-app items are a limited license to use within the Service for entertainment only; they have no cash value, are not your property, are not transferable outside the Service, and may be modified or discontinued at any time.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. No other rights are granted.

You may NOT, directly or indirectly:

• Copy, reproduce, clone, "rebrand", or create a derivative or substantially similar product or service based on AIR.POG, its features, look-and-feel, or branding;
• Reverse-engineer, decompile, or attempt to derive the source code, structure, or underlying ideas of the Service;
• Scrape, crawl, harvest, or bulk-extract data, listings, deals, images, or POGs from the Service by any automated or manual means;
• Access the Service or our APIs other than through the official interface we provide;
• Use the AIR.POG name, logo, or "Just POG it." mark, or any confusingly similar mark, without our prior written permission;
• Resell, sublicense, or commercially exploit the Service or its data;
• Circumvent rate limits, security, or access controls; or interfere with or disrupt the Service;
• Use the Service, its data, or its outputs to train, fine-tune, or evaluate any machine-learning or AI model or dataset;
• Access or study the Service for the purpose of benchmarking, competitive analysis, or building a product or service that competes with AIR.POG; or
• Frame, mirror, or embed the Service or substantial portions of its data in any other website, app, or product.

Violation of this Section is a material breach. We may suspend or terminate access immediately and pursue all available legal and equitable remedies. You agree that a breach of this Section would cause AIR.POG irreparable harm for which money damages are inadequate, and that AIR.POG is entitled to injunctive relief in addition to all other remedies, without the requirement of posting a bond.

The Service embodies confidential and proprietary systems and know-how of AIR.POG, including without limitation the geo-based business tracking and discovery engine, the POG'D ZONE instant local data architecture, POG SCAN, the live deal-drop engine, POG BEAM remote streaming, the gamified reward and collectible systems, and related algorithms, data structures, and compilations (collectively, "AIR.POG Trade Secrets"). These constitute protectable trade secrets and proprietary compilations under applicable law, including the Defend Trade Secrets Act.

By using the Service you agree not to misappropriate, disclose, or use any AIR.POG Trade Secrets, and that the compilation, selection, and arrangement of business, deal, and map data in the Service is the proprietary work of AIR.POG, regardless of the source of any individual data point.

When you check the acceptance box on first visit or create an account, AIR.POG records your acceptance of these Terms (including a timestamp, terms version, and technical identifiers) as evidence of this agreement. This record constitutes a binding electronic signature under the U.S. E-SIGN Act and applicable state law.

You retain ownership of content you post (deals, POGs, photos, logos), but you grant AIR.POG a worldwide, royalty-free license to host, display, resize, and distribute it within the Service and in share previews. You are responsible for your content and must have the rights to post it. You may not post unlawful, infringing, misleading, or harmful content.

Deals are exclusive to AIR.POG.

Any deal, sale, discount, coupon, or offer a business publishes through AIR.POG is made available to customers exclusively through AIR.POG and is redeemable only by presenting the live, app-generated AIR.POG redemption screen (QR code / verification) to the business. Businesses agree to honor these offers solely via AIR.POG redemption, and customers agree such offers are valid only when redeemed live in-app (screenshots and copies are not valid).

Paid features are billed via our payment processor (Stripe). Prices and durations are shown at checkout and may change. Except where required by law, payments are non-refundable. You authorize us to charge your selected payment method for the features you purchase.

The Service uses third-party data and services including OpenStreetMap/Overpass (map and place data), Google (sign-in), and Stripe (payments). Their data and terms apply to their respective content. Map and business data may be incomplete or inaccurate; we make no guarantee of accuracy.

The Service is provided "AS IS" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages, or for decisions made based on map, deal, or POG information. Always follow local laws and drive safely — do not interact with the app while driving.

We may suspend or terminate your access at any time for any violation of these Terms. Sections relating to intellectual property, prohibited conduct, disclaimers, and liability survive termination.
